What does the temporary right of residence for displaced persons from Ukraine mean for me?

As a displaced person from Ukraine, you have a temporary right of residence in Austria. This right of residence is currently valid at least until 3 March 2023 and can be extended if necessary. This right of residence exists from the time of your entry into Austria and is documented by an “ID card for displaced persons”.

Як вигнана особа з України, ви маєте право тимчасового проживання в Австрії. Наразі це право на проживання діє до 3 березня 2023 року і може бути продовжене в разі потреби. Це право на проживання підтверджується «Ідентифікаційною карткою для вигнаних осіб».

How do I get a temporary residence permit? Do I have to submit an application?

If you belong to one of the groups that are granted a temporary right of residence in Austria by law, the Federal Office for Immigration and Asylum (BFA) will issue you with an ID card for displaced persons. For this purpose it is necessary that you register at the registration offices of the police.

Note: It is not necessary to file an asylum application. If you have already filed an asylum application, it will not be processed for the duration of your right of residence as a displaced person. If you have already applied for asylum and would like to obtain an ID card for displaced persons, please contact the BFA.

Як отримати дозвіл на тимчасове проживання? Чи потрібно подавати заявку?
Якщо ви належите до однієї з груп, яким за законом надано тимчасове право на проживання в Австрії, BFA видасть вам посвідчення особи для переміщених осіб. Для цього необхідно зареєструватися в реєстраційних відділах поліції.
Примітка. Прохання про надання притулку не потрібно. Якщо ви вже подали заяву про надання притулку, вона не розглядатиметься протягом дії вашого права на проживання як вигнанноі особи. An initial registration is done by the police. This can be done at certain police stations or at special reception centres.

During registration, your data and the data of your passport or other documents are taken. Fingerprints will be taken from persons 14 years and older. A photograph will be taken of each person. There is a form which you are requested to fill in, sign and hand in at the time of registration. In order for the ID card for displaced persons to be sent to you, it is absolutely necessary that you register at your current address as well as re-register if you change your residential address. The ID card for displaced persons can only be sent to you if you register. Please understand that it may take several weeks for the ID card to be sent to you.

Please take the following with you to the registration (if available):
– Passport
– Birth certificate, marriage certificate, other civil status documents
– Other identity documents, such as identity card, driving licence, residence permit, etc.

Do I have to register in Austria?

Yes. Whether, by whom and how depends on the type of accommodation. If you are staying in Austria for more than three days, you have to register your residence at the responsible registration office (municipalities/magistrates) in accordance with the Registration Law.

• In the case of private accommodation, you have to report your place of residence directly to the registration office within three days after moving into the accommodation, whereby you need a corresponding confirmation of your accommodation provider (owner, private landlord, etc.).
• If you are accommodated within the framework of a lodging/tourist establishment, the registration is carried out by the owner in accordance with the relevant regulations (depending on the duration of the stay, e.g. entry in the guest register).
• In the case of admission to basic care in organised accommodation, this notification is arranged by the BBU or the respective competent provincial basic care office.

There is only an exception to the obligation to register if you do not stay in Austria for more than three days – for example, if you are only passing through Austria.

Кому я повинен повідомляти про проживання в Австрії (Приписка)?

Відповідно до Закону про реєстрацію, особи, які проживають в Австрії більше ніж три дні, повинні зареєструвати своє місце проживання у відповідальному органі реєстрації (громади/магістрати).

• У разі приватного розміщення реєстрація місця проживання має бути здійснена безпосередньо в органі реєстрації протягом трьох днів після  заселення в житло, при цьому постачальник житла (власник, приватний орендодавець тощо) повинен відповідним чином підтвердити проживання.
•  У разі наданні первинноі допомоги в організованих житлових приміщеннях здіснюеться регістрація/приписка відповідно до відповідних положень (залежно від тривалості перебування, наприклад, запис на гостьовому листі).
• У разі наданні первинноі допомоги в організованих житлових приміщеннях буде приписка ініціюється/проводитися BBU GmbH або відповідним державним базовим офісом постачання.

Винятк: якщо житло не береться більше ніж на три дні.

I fled Ukraine, but my family is currently in … Can I bring them to Austria?

If you are a Ukrainian citizen or a third-country national with asylum or a comparable protection status in Ukraine, then the temporary right of residence also applies to your family members – provided that they have already lived with you in Ukraine before 24 February 2022. Family members include spouses or registered partners, minor unmarried children (also of the spouse or registered partner) as well as other close relatives who lived with you in a domestic community before the expulsion and were dependent on you.

As a displaced person from Ukraine, am I allowed to work in Austria and do I get free German courses?

Yes, with an ID card for displaced persons you have access to the Austrian labour market. However, it is necessary to register at the Austrian Public Employment Service (AMS) with the ID card for displaced persons. There, your data such as your education, your professional experience and competences as well as other information about your person will be collected. The AMS will support you in finding a job and will then issue you with an employment permit with which you will be able to work. If you have already found a job in Austria, your future employer can also apply for the employment permit.

Furthermore, subsidies and active placements are provided by the Austrian Public Employment Service (AMS), and you can also take advantage of other AMS services such as counselling and German courses.

As a refugee or displaced person from Ukraine, am I covered by health insurance in Austria?

Yes. In principle, health care is ensured within the framework of admission to basic care.

As proof of health insurance, you will be assigned an insurance number after registration – at the customer service points of the Austrian Health Insurance Fund (ÖGK), this can be used to issue an e-card replacement voucher.

Even if you do not yet have an insurance number and an e-card replacement voucher, medical care is still guaranteed by presenting the appropriate proof (passport or other residence documents relating to Ukraine).

Further information on health insurance can be found on the homepage of the ÖGK.

Even if you are not included in the basic health care because you do not need support services, you are entitled to health insurance within the framework of the General Social Insurance Act and can also make use of medical assistance. The legal and organisational requirements will be met in the next few days.

Медичне страхування

• В принципі, медичне обслуговування забезпечується в рамках допуску до базової допомоги шляхом реєстрації в медичній страховій компанії та сплати внесків.
• В іншому випадку вигнані в рамках § 9 ASVG, можуть звернутися за медичною допомогою або отримати ліки та медичну допомогу. Правові та організаційні вимоги будуть виконані в найближчі дні.
• Як підтвердження їхнього права на пільги після реєстрації їм буде присвоєно страховий номер, а в пунктах обслуговування клієнтів Австрійської каси медичного страхування можна буде видати заміну електронної картки.
• Якщо немає страхового номера або документа, що замінює електронну картку, медична допомога все одно буде надана після пред’явлення відповідних доказів (паспорт або інші документи на проживання, що стосуються України).
